GENERAL CONDITIONS
 

1.General conditions of the accommodation facility
All guests (and anyone else visiting the property) must adhere to the rules of this accommodation facility and any other instructions provided during their stay at Modena Relax.
For any issues or specific concerns, guests are kindly requested to contact the management of the property immediately.
By confirming the reservation, you accept our general terms of service..

2. Check-in and check-out times:
Il check-in, With mandatory personal document verification., It is possible from 2:00 PM to 6:00 PM at the back-office of the property on the 1st floor.
The check-out must be completed by 10:00 AM.
By prior arrangement, it is possible to check-in with in-person document verification either in advance or later than the standard time.

3. Booking conditions
Bookings for the stay at Modena Relax can be made through online channels or by direct request on the website or by email.
In all cases, the guest undertakes to provide us with an active email address or other contact information at the time of booking and authorizes us to use it for communication and verification purposes in relation to the booking.
In the event that the user is not reachable by email or telephone, or provides an incorrect or invalid email address, we reserve the right to cancel such booking.

4. Payment and cancellation conditions
Option 1: "FREE Cancellation"
When checking in via email or website, we will ask you for your credit card details, which will be considered as a guarantee of payment.
The guest can cancel the reservation without any cancellation fee up to 5 days before arrival.
The cancellation must be made in writing.
In case of cancellation within the specified period before arrival or in case of no-show at the hotel, the full amount will be charged.
Option 2: "Reservation WITHOUT REFUND"
Reservations without refund require full payment in advance at the time of booking and subsequent cancellation or modification of the reservation is not possible.
If the credit card details are incorrect or for other reasons it is not possible to charge the card, Modena Relax reserves the right to cancel the reservation. If the reservation includes contact details, Modena Relax will inform the guest and request new credit card information.
If the guest cancels or modifies the reservation or in case of no-show at the property, the total amount of the reservation will be charged.
Option 3: Early departure
If the guest leaves the property without notice, Modena Relax will charge the full amount of the reservation even if unused, unless otherwise agreed.
For reservations made more than 30 days before arrival, a full advance payment is required as a deposit. The deposit amount is refundable up to 5 days before arrival. After that, free cancellation is no longer possible and the deposit amount becomes non-refundable (cancellation fee).
For reservations with a non-refundable rate made within 30 days before arrival, immediate full advance payment is required, which is non-refundable.
Requests for an advance invoice for the advance payment and/or additional information must be requested at the property's email address (prenotazioni@modenarelax.it).
Advance payment can be made by bank transfer or credit card. If the contact details provided are not valid or if the credit card is not active, Modena Relax reserves the right to cancel the reservation.

5. Right of refusal and modification
We reserve the right to refuse a reservation and, in special circumstances, the right to cancel, modify or adapt your reservation.
If we are forced to cancel, modify or adapt the reservation, the guest will be offered an alternative date.
Modena Relax does not assume liability for any failure to perform due to force majeure. Cases of force majeure and unforeseen circumstances are those generally recognized by legal practice and the courts.

6. Tourist tax and registration fee
The price of the accommodation is increased by the amount of the tourist tax, as established by the Decree of the Municipality of Modena, in a single sum.

7. Prices
The prices of the accommodation include the value added tax (VAT). The price is valid for each individual room/apartment/suite, for the number of people selected, on the chosen date.
The price list may vary according to supply and demand.
The accommodation price does not include drinks, food and other services.
Special and promotional offers are only valid if the stay is not shortened.
Discounts are not cumulative.

8. Additional offer
All additional offers are available upon request and subject to availability.

9. Rules for staying at the property
In order to ensure a pleasant stay for all guests, a "quiet commitment" is in force in the guest rooms and common areas of Modena Relax.
Guests are fully responsible for the safety of accompanying children during their entire stay and for any disturbance caused to other residents in the neighborhood.
Guests must minimize noise especially during quiet hours (10:00 p.m. to 8:00 a.m.) and upon arrival and departure from the property.
Each time guests leave the property it is their responsibility to ensure that all windows and doors are closed/locked, in order to ensure the safety of the property and prevent damage caused by atmospheric events. Guests must turn off lights, air conditioning, fans, appliances such as televisions when these are in use, in favor of energy saving. 
If there are justified complaints of excessive noise from other guests, the guest causing the noise must leave the hotel immediately without any refund.
Smoking is prohibited inside Modena Relax. The facility is equipped with an electronic signaling system for the presence of smoke. In the event of an alarm and/or if the presence of smoke is evident in any way (smell, cigarette butts, etc.), a penalty of 250 euros will be charged to your account.
The absolute ban on smoking offers a better and safer experience for all guests, especially those with respiratory problems: passive smoking and third-hand smoke can have lasting negative effects on health, especially for those who suffer from asthma. Furthermore, the ban on smoking helps us to keep our facility in good hygienic conditions and to preserve furniture and linens but above all to prevent the risk of fire and therefore to guarantee greater safety for all guests present.
Misappropriating objects from the facility is considered to all effects a theft, a crime punishable by imprisonment from six months to three years and a fine from 154 euros to 516 euros.
Theft is punishable by complaint of the injured party and occurs whenever anyone takes possession of someone else's movable property, stealing it from the person holding it, to make a profit for themselves or others. Furthermore, arrest is also provided for in the event that the person responsible is caught in the act.
The person in charge of the facility may, therefore, within three months of when the fact occurred, or from when the person became aware of it, file a complaint against the person responsible, to ensure that the person is punished and to obtain compensation for the damage, constituting himself as a civil party in the criminal proceedings.
We pay particular attention to providing clean rooms to our guests. In the event of major stains or damage to our property, you agree to pay a cleaning fee of at least 50 euros or the full cost of repairing/replacing the damaged equipment.
Any additional expenses relating to the room, apartment, or suite may be paid during the stay or at check-out.

10. Parking
Parking in the property's garage is subject to charges for guests of the property, subject to reservation.
Parking spaces are limited so reservations must be made to ensure that they are available upon arrival at the property.

11. Loss and Damage to Guest Property
Unfortunately, we cannot be held responsible for any loss or damage to property or any injuries sustained by you or any member of your party during your stay at our property.
You may store money and valuables in the in-room safe.

12. Pets
Pets are not allowed.

13. Complaints
If a malfunction occurs in the room, the guest must immediately notify the property manager or housekeeper and allow maintenance staff to resolve the issue within a reasonable amount of time. Failure to comply with this provision will result in no changes to the length of stay or discounts for a lesser stay experience.

14. Access and right of entry to the room
Overnight stays in the rooms of the property are authorized only to guests duly registered at the time of booking.
We reserve the right to access the room at appropriate times and for legitimate reasons.
The property manager, waiters and maintenance staff may access the room at any time without prior notice for legitimate reasons, in particular for urgent maintenance and inspections.

15. Intellectual Property
The symbol, name and logo are fundamental elements of the visual identity of the Modena Relax company. Their use is permitted exclusively with the consent of the owner.
